The Department of Veterans Affairs (VA) will provide abortion services, regardless of state abortion laws, in response to the Supreme Court’s decision to overturn the federal right to an abortion.
So does the Department of Veterans Affairs under the Biden administration have the authority to change its health care policy to include abortion services? Oliva and Benjamin McMichael, associate law professor at the University of Alabama School of Law, spoke to Yahoo News to help explain the legality of this emerging abortion battle in Congress. So the VA final [interim] rule leans into this and basically says the secretary of the Veterans Administration has determined that abortion services are needed in a post-Dobbs world, and that is perfectly consistent with the 1996 act, giving the secretary the authority to make that determination. So that's what the VA is leaning into as well.
So this is a rule that's already on the books, the administration isn't inventing anything new, and this has not been controversial previously. I think that it's certainly going to be debated widely in this context.
