The near-total abortion ban does not include exceptions for rape and incest. The bill now goes to the state Senate.
The Alabama House of Representatives passed a bill Tuesday that would ban nearly all abortions in the state.
Some Alabama Democrats walked out ahead of the vote in protest after trying to add an amendment that would have provided exceptions for rape and incest. The Republican majority voted to table the amendment. “Essentially this is a meaningless act,” Marshall said. “It will not go into effect and ultimately, it is likely to cost Alabama taxpayers hundreds of thousands of dollars, if not over a million dollars, in legal fees.”
Elisabeth Smith, the chief counsel for state policy at the Guttmacher Institute, called the bill blatantly unconstitutional. Eric Johnston, president of the Alabama Pro-Life Coalition, said he was happy with the vote. He said legislators are representing the will of the people, pointing to a 2018 state ballot measure that amended Alabama’s constitution to include that state policy was to protect “the sanctity of unborn life and the rights of unborn children, including the right to life.
