An appeals court will not take up the case of former Brecksville City Councilman Jack Petsche, whom a judge found not guilty of corruption charges.
Prosecutors admitted the appeals court could not change Petsche’s acquittal under rules barring double jeopardy.
Prosecutors argued that Petsche and his company, USA Roofing, had not yet gotten paid for the roofing work when he voted to give the general contractor, Panzica Construction Co., more money for the project. If Panzica didn’t get paid, prosecutors argued, then USA Roofing couldn’t get paid. Russo found that there was insufficient evidence to convict Petsche because prosecutors failed to show that he had a “definite and direct fiduciary or pecuniary interest” in his votes to fund the project. Russo also found prosecutors failed to show that Petsche “knowingly committed an act that violated the law.”
