OAKLAND — A 33-year-old Berkeley man accepted a voluntary manslaughter conviction and a 27-year prison term to settle a murder case in the 2016 shooting death of his friend, court records show.
Julius Johnson pleaded no contest to killing Tavio Briggs, 23, of Oakland in the Sept. 25, 2016 West Oakland shooting. He is scheduled to be formally sentenced on Jan. 27, and will remain in Santa Rita Jail in Dublin in the meantime.and has been held at the jail since then. He will receive credit for time served, and be able to reduce his prison sentence by 15 percent with good behavior, court records show.
Police said at the time of the arrest that Johnson and Briggs had been friends but that the shooting was the result of a fallout between them. Prosecutors said in court records that the night before the shooting, the two were at a party on Poplar Way in Oakland, where Johnson was seen walking around with a gun.
At around 1 a.m. Sept. 25, outside the residence where the part occurred, Briggs and Johnson were seen chatting as Johnson sat in the driver’s seat of a BMW. An eyewitness heard Briggs say, “be cool, bro” and saw Johnson raise a pistol and fire several shots, killing Briggs, according to prosecutors.
