Biden to veto GOP bill overturning ATF pistol brace rule
The Bureau of Alcohol, Tobacco, Firearms, and Explosives issued a final rule in January declaring any pistol bearing stabilizing braces or other accessories as short-barreled rifles, which require a federal license to own.Reps. Andrew Clyde and Richard Hudson introduced a resolution in March that would overturn Biden's rule. House Republicans have claimed that the Biden rule would subject firearm owners to fines of $10,000 and 10 years in jail if they do not turn over firearms to the ATF.
"The Biden Administration has unleashed unelected bureaucrats in the ATF to criminalize firearm ownership for millions of Americans. This is an unconstitutional assault on the Second Amendment and another example of President Biden’s weaponization of the federal government against hard-working American families," House Majority Leader Steve Scalise said of the bill in June.
The bill is not likely to pass the Democratic-controlled Senate, but the White House Office of Management and Budget said in a statement of administration policy that Biden would veto the bill if it does reach his desk."The Administration strongly opposes H.J. Res. 44, Disapproving the U.S. Department of Justice Bureau of Alcohol, Tobacco, Firearms and Explosives rule relating to 'Factoring Criteria for Firearms with Attached"Stabilizing Braces.
"Recently, however, the gun industry has circumvented this longstanding law by manufacturing and selling so-called 'stabilizing braces' that convert heavy pistols into short-barreled rifles. As a result of this industry innovation, in the past few years we have witnessed mass shooters — including those in Dayton, Ohio, and Boulder, Colorado — use these 'brace' devices on heavy pistols in order to inflict mass carnage," the statement continues.
