The case of a former Chicago Police Sergeant charged with pinning a young Park Ridge teen to the ground outside a local coffee shop over the summer continues to wind its way through the legal process, with the next court date set for next month.

The case of a former Chicago Police Sergeant charged with pinning a young Park Ridge teen to the ground outside a local coffee shop over the summer continues to wind its way through the legal process, with the next court date set for Dec. 15.

Attorney Alyssa Janicki of the Cook County State’s Attorney’s office said the state was waiting for the Chicago Civilian Office of Police Accountability to respond to a subpoena.Vitellaro is charged with two counts of official misconduct and one count of aggravated battery against a Park Ridge teen who has, since the incident occurred, become a freshman at Maine South High School. He was 14 years old at the time of the incident.Aug. 18.

In previous court appearances and at the time of the incident, Vitellaro and his lawyer James McKay have stated that Vitellaro thought the boy was stealing his son’s bike the weekend of July 1. Park Ridge police have said another person took the bike. Video footage of the incident shows the boy looking up while Vitellaro holds him to the sidewalk with one knee in his back.

According to a statement from the Cook County State’s Attorney’s office, Vitellaro completed forms characterizing the incident as an off-duty arrest and the boy as a noncooperative offender the day after the incident took place.The family of the boy, who is of Puerto Rican descent, has retained the legal firm Romanucci Blandin to represent them and their son. Attorney Antonio Romanucci has said he sees the case as one of racial profiling.
