The city submitted its second appeal last week and requested a ruling by Friday.
to rule on the matter by Jan. 6, the Friday before the Monday candidate qualifying begins for the March election. They also requested Judge Marcia Morales Howard, the federal judge who initially ruled against them, approve a request this week to waive the city’s residency requirement for candidates – suspending the rule that candidates have to live in their district for at least 183 days before qualifying.
The remedial map was never put in place because Howard deemed it unconstitutional, meaning a stay would actually have to put in place the 2011 redistricting map in the March election with districts that are now not reflective of population changes, the plaintiffs said. “Last week, everything changed. Why? Because the district court didn’t rubber-stamp the City’s proposed remedy,” the plaintiffs’ filing said. “Suddenly, at the Council’s behest, the City realized it had an extra three weeks before the impending pandemonium.”
