MARTINEZ — The Contra Costa County District Attorney’s Office said Thursday it would not file any charges in an altercation over a Danville Costco parking spot, referring to the conflict over a parking space between two men as “mutual combat” not rising to a standard worth bringing before a jury.
Wilks walked reporters through footage from two cameras, outlining the initial contact between Craig Blackburn, 67, and the man he told this news organization had grown impatient waiting for his parking spot, while Blackburn loaded groceries into his car. He said the two exchanged threatening words to one another, including some as Blackburn returned his shopping cart after unloading his groceries. Eventually, the man parked in another spot, he said, but then walked by him shouting as Blackburn tried to pull out.
“One of the significant factors for us in considering this case is that the victim, having already had that altercation in a moment, appears to return to the suspect vehicle,” Wilks said of Blackburn. “This is the second encounter between the two individuals.”
