A Regina judge's decision to acquit a former gastroenterologist on seven counts of sexual assault came under scrutiny Monday morning.
The Crown appealed Scherman’s decision saying his approach was “rooted in a paternalistic, stereotypical ‘rape-myth’ perspective that has no place in our criminal justice system.”
“One of the primary disincentives and reasons for the chronic under-reporting by female sexual assault victims is the fear of victimization at the hands of the justice system,” said Hession-David. Schwann raised the point that a great deal of trust is placed in medical professionals and that might preclude someone from speaking up during a procedure.
During much of Fox’s time addressing the justices, many women in the gallery shook their heads. Occasionally, one woman was visibly shaking.
