In his ruling signed on Feb. 10, Denver District Court Judge Ross Buchanan found that the plaintiffs lacked standing to bring the suit, in part because the city and Westside Investment Partners, the developer that bought the property in 2019, have not yet requested that the conservation easement be lifted.
“Thus, as it turns out, under the newly adopted Ordinance, there is another available remedy separate from an order of this court, i.e., putting the question to the voters in a municipal election,” Buchanan wrote. Tate, in Wednesday’s statement, disputed the idea that his group is committed to seeing the property remain a golf course in perpetuity. Instead, Save Open Space Denver is “fighting to preserve the land consistent with the open space and recreational conservation purposes of the conservation easement,” he said.
