DOJ opinion: “States may not impose criminal or civil liability on VA employees — including doctors, nurses, and administrative staff — who provide or facilitate abortions or related services in a manner authorized by federal law, including VA’s rule.'

The Justice Department will provide legal representation for medical workers at Veterans Administration hospitals in Alabama if they are prosecuted for providing abortions to veterans or their spouses in cases of rape and incest.comes a day after the department issued an internal opinion finding that the VA’s policy is legally sound.

“The rule issued by the Department of Veterans Affairs on Reproductive Health Services is a lawful exercise of VA’s authority,” DOJ’s Office of Legal Counsel wrote in the opinion. “States may not impose criminal or civil liability on VA employees—including doctors, nurses, and administrative staff—who provide or facilitate abortions or related services in a manner authorized by federal law, including VA’s rule.

“For this [Biden] administration, there is nothing more important than attempting to bully conservative states on every major issue, including abortion, even when the Administration lacks the authority to do so,” Alabama Marshall said in a statement earlier this month to“I have no intention of abdicating my duty to enforce the Unborn Life Protection Act against any practitioner who unlawfully conducts abortions in the State of Alabama,” the attorney general continued.

Alabama’s abortion ban bars abortions in those cases, but not when the life of the mother is in danger -- cases which VA hospitals said they would also provide abortions to qualified patients. Note to readers: if you purchase something through one of our affiliate links we may earn a commission.
