Evanston cracks down on single-use bags with new tax

Evanston’s City Council on May 22 approved an ordinance that will put a 10 cent bag fee at select retailers and require paper point-of-sale bags to consist of at least 40% post-consumer recycled materials.

Both the compostable material requirement and bag fee will go into effect on Aug. 1, according to Pratt’s memo. The bag fee will not apply to restaurants, non-chain store organizations, retailers with less than 10,000 square feet and Supplemental Nutrition Assistance Program participants. Prescription drug, newspaper, and pre-checkout produce bags are also exempt from the 10-cent fee.

Evanston’s latest 10-cent proposal is a decrease from the 15-cent fee it considered in December. The ordinance was initially proposed as a 10-cent fee. Retailers that violate any provision outlined in the ordinance will be subject to a fine of $100 or more for each offense. The ordinance states that each day the retailer continues to be in violation will be considered a “separate and distinct offense” and may result in the business’ retail establishment’s business license being revoked or suspended.
