Claim says Jesus Salvador Veleta was attempting to surrender to police when he was fatally shot

The family of a man who was shot to death by police last summer has filed a $20 million legal claim against the city of San Diego alleging he was wrongly killed.

“The officers used excessive and lethal force on Mr. Veleta, who was surrendering and with his back turned to them,” the complaint states.“More specifically, he was on his knees and facing away from them,” attorney Elliott Kanter wrote in a letter accompanying the legal claim. “Mr. Veleta died as a result of the gunshot injuries that he suffered.”

The incident began on the night of July 23, when police responded to reports of a shooting near El Cajon Boulevard and 58th Street in the Rolando area of San Diego. He was seen running from the vehicle with a gun in his hand near the intersection of El Cajon Boulevard and 54th Street.Police said he did not comply with the officers’ command to drop the gun and appeared in the video to be in the process of pointing his gun at the officers.Veleta was struck at least once and died later at a nearby hospital.
