District Attorney Sean McCormack will not prosecute in the death of Roger Wayne Ellis during a warrant service.

News conference on police fatal shooting of Roger Wayne EllisCARLISLE - The Feb. 16 shooting death of a Carlisle-area man sought by police on counts stemming from a January car chase in Camp Hill has been ruled a justifiable use of force by Cumberland County District Attorney Sean McCormack.

“It is the determination of the district attorney’s office that there are no criminal violations on behalf of the officers and that this is what people might call, unfortunately - and I don’t like the term - but, a ‘good shoot,’” McCormack said. “This is a situation where the officers felt - particularly the officer that was hit - that his life was in danger and that he had no choice.

Police at that time were hoping to call a negotiator to the scene and get help to get Ellis into custody without further violence, McCormack said, but Ellis fled out of the trailer’s bedroom window, leading to the second confrontation.“The officers, at every step along the way in the course of this incident, their initial reaction was to pull back,” McCormack said. “Pull back. McCormack noted toxicology tests on Ellis showed methamphetamine, cocaine and marijuana in his system. “We do not know what was going through his mind that afternoon. I can imagine that drugs did play a role in the decisions that he made,” McCormack said. McCormack said a routine run of Ellis’s plate outside a convenience store there showed that Ellis’s license was suspended. And police were able to call up photos of Ellis and verify that he was the driver as he exited the store. After two different attempts to stop him that evening, police broke off the pursuit, but drew up charges for fleeing and eluding police.
