During yesterday's hearing regarding AB 2098, California's new censorship law, a federal judge called the state's definitions of misinformation 'nonsense.' Multiple doctors and organizations are suing on claims that the law violates the First Amendment.

SACRAMENTO – AB 2098 was passed through State Legislature and put into effect on Jan. 1, 2023, as a protection against the spread of COVID-19 “misinformation” between medical professionals and patients. The law has come under scrutiny due to its broad definitions of misinformation which includes discussion of alternative treatments to COVID-19 not accepted by the majority of medical and scientific professionals.

Two organizations and a group of doctors are attempting to sue multiple state officials on claims that AB 2098 violates the First Amendment. On Monday, Jan. 24, Senior Judge William Shubb called its definition of misinformation “nonsense.” Shubb hinted during the hearing on Jan. 24 said the law lacked clarity, leaving many hopeful for AB 2098’s demise.
