A 30-year-old Florida man was arrested this week after being caught while allegedly attempting to film the inside of a neighbor's apartment, police say.
Randall Trong Tran, of Cape Canaveral, was taken into custody shortly before 10 p.m. yesterday by deputies from the Brevard County Sheriff's Office, according to an arrest affidavit published by the county clerk. The incident took place on September 22, the records noted.Police said they responded to a complaint about a disturbance at an address on Fillmore Avenue, where the victim, named as Mr. Bush, relayed what had happened.
According to the probable cause affidavit, the victim confronted Tran after spotting him standing outside his apartment's window and trying to make a video recording of the interior. When the victim approached Tran to ask what he was doing, the suspect attempted to flee the area,When he was trying to run away, Tran hurled a full bag of trash at the victim, which allegedly hit him directly in the face.
The Brevard County Sheriff's Office records said Tran later locked himself in his own Fillmore Avenue apartment and"would not open the door to make contact with deputies."Tran is now facing a charge of battery, a first-degree misdemeanor, and is scheduled to appear in the Brevard County Courthouse at 9 a.m. on October 14. He was being held on $500 bond.
Upon conviction, penalties for the charge can include up to one year in jail or 12 months probation, and a $1,000 fine, according to Florida-based law firm"In all Florida prosecutions, it is a required element of battery that the touching at issue occur without the consent of the alleged victim, or 'against the person's will,'" the legal outfit notes in an online fact-sheet, adding:"Unlike other misdemeanors, prosecutors in Florida do frequently seek jail sentences or...
