Prosecutors say while former Crestwood Mayor Lou Presta is claiming hardship as he fights efforts to turn over pension contributions to the government, he and his wife have equity in their home and own vacation property in Michigan, court filings show.

Prosecutors are seeking to lay claim to money Presta paid into a state pension to apply toward a restitution judgment against him.Presta’s attorney, Burt Odelson, says the former mayor, sentenced to prison for taking a $5,000 bribe, is working to make restitution payments although he and his wife are unemployed and live on Social Security benefits and money from their children.

Prosecutors, however, say the money should go toward restitution Presta agreed to when he pleaded guilty in November 2021 to federal charges, including using a facility in interstate commerce in aid of bribery, official misconduct and tax counts alleging he failed to file an income tax return and also willfully filed a false income tax return.

Odelson notes participants in the Illinois Municipal Retirement Fund convicted of a felony, as Presta was, forfeit pension benefits, or any interest accrued on contributions, but said the former mayor still has claim over what he paid into the pension system.
