David Finn, 60, blamed his alcoholism for his conduct, which an investigation found included rudeness to judges, unwanted touching of a court security officer and missed court hearings.A former federal prosecutor and Dallas County judge has been suspended from practicing law in North Texas federal courts for a year following an investigation that found his alcoholism led to rude and inappropriate behavior toward federal judges and court staff.
“I’m definitely not a saint,” he said. “If you read my…reviews for the past few years you’ll see that my clients know I will fight for them.”Finn may reapply for reinstatement if he provides proof of sobriety, according to the order.
• Appearing before U.S. District Judge Ada Brown in February 2021 while “clearly intoxicated;” making an “inappropriate race-based joke;” and telling the judge she wasn’t qualified to preside over the matter. Finn’s father also was a Dallas attorney and a heavy drinker, Stalcup wrote in the filing. He said his client has been in and out of treatment centers since 2017. Finn lived in a “sober living apartment” for almost two years, but his father’s death in 2018 triggered his alcoholism and he moved out, the court filing said.Finn, who earned his law degree from the University of Texas, served as a Dallas County criminal court judge from 1999 to 2002.
Two days later, Lynn convened the three-judge panel chaired by David Godbey, who has since become the chief district judge, along with Judge Sam Lindsay and Judge Mark Pittman “to review various incidents involving the conduct of attorney David Finn.”Finn appeared before Lynn that same month and apologized for missing the two court dates, saying he has a “progressive disease that is trying to kill me,” court records show.
