Gregg Costa, a judge who quit the conservative Fifth Circuit appeals court, is joining the law firm Gibson Dunn

Former federal judge Gregg Costa is about to join Gibson Dunn in a senior role, Insider has learned.

Costa is joining the law firm's Houston office as a partner with a leadership role and is expected to work on white-collar matters, the person said. While Costa's return to the private sector has been expected since January, when his departure from the Fifth Circuit Court of Appeals was announced, his planned move to Gibson hasn't been reported.

Costa's decision to step down from the Fifth Circuit took many by surprise, given how rare it is for judges, who have life tenure, to leave before they reach retirement age. Costa clerked for the conservative Supreme Court justice William Rehnquist and was appointed by President Barack Obama, first as a district court judge in Galveston, Texas and later as an appeals judge.
