Gunmaker Daniel Defense, former Robb principal ask courts to toss suits filed over Uvalde shooting

Reggie Daniels pays his respects a memorial at Robb Elementary School on June 9, 2022, in Uvalde for the victims of a mass shooting at the school. The firearms company that made the assault-style rifle the gunman used in the Robb Elementary mass shooting in Uvalde, and the school’s former principal have asked a judge to toss separate lawsuits filed against them over the massacre.

Attorney Charles Bonner spent weeks in Uvalde after the shooting signing clients and then filed separate federal lawsuits seeking $6 billion or more in damages. In one, he sued Georgia-based Daniel Defense, which sold the rifle online to 18-year-old Salvador Ramos, and Oasis Outback LLC, the Uvalde gun and sporting goods store that processed the gun transfer to Ramos after Daniel Defense shipped the firearm.

Prichard argues the suit should be dismissed because lawyers for the plaintiffs, 26 students and two bus drivers who were at the school when the shootings happened, failed to properly show “subject matter jurisdiction.” Federal courts can preside over civil actions where the amount in dispute exceeds $75,000 and is between citizens of different states.
