In response to a request for comment, the Hamilton County Prosecutor's Office pointed out that the errors occurred under the leadership of Lee Buckingham, whose tenure as top prosecutor wrapped up last year after he lost the Republican primary to Greg Garrison.The office's chief counsel Jeff D.
Hughes, who earlier last year warned prosecutors of"huge" sanctions if discovery problems persisted, said he fears these types of critical evidence delays might not be isolated to the Whitmore case.According to the judge, Buckingham told the court his office had heard the court’s reprimands loud and clear. But “the court wonders if this is true,” Hughes wrote in December.
There's no mention in the affidavit of his DNA being found in the teen's room, but law enforcement did say they found DNA that likely belonged to Whitmore and the teen in an office chair where the teen alleged abuse had occurred. During a deposition the teen said they were"pretty sure" they searched online for “penalties for sex abuse crimes” for the first time after Whitmore took their phone in January 2018. They also acknowledged searching for"sex abuse signs" around that same time.
