An ethics board declared that former governor Andrew Cuomo must repay the more than $5 million in compensation he got from his pandemic book.

New York State’s ethics commission voted Tuesday to require former governor Andrew Cuomo to repay the more than $5 million in compensation he received for a book he wrote in 2020 on his handling of the COVID-19 pandemic.

The commission declared that repayment is necessary because, in its words, Cuomo isn’t “legally entitled to retain compensation” he earned from the book’s publication, as he “lacked legal authority to engage in outside activity.” Last month the panel revoked the approval it had previously granted him to do the book, saying he’d violated the agreement that dictated he write the tome on his own time, without the help of government resources.

In a statement, Cuomo’s lawyer called the decision “unconstitutional” and said the panel’s actions “appear to be driven by political interests rather than the facts and the law. Should they seek to enforce this action, we’ll see them in court.”
