Kelly was arrested after sheriff’s deputies found Cuen’s body on the rancher’s property, close to the U.S.-Mexico border. Kelly has pleaded not guilty and was released on a $1 million cash bond on Feb. 22. The state executed an additional search warrant on Monday on Kelly’s property, Larkin said, and she asked that a trial not be set until the defense had time to review the results of that search warrant. Officials previously executed at least two search warrants in this case on Kelly’s property.
The prosecution’s position in the case is that Kelly shot an unarmed man in the back in an unprovoked attack as he ran for his life with no warning. The man was with a group of about eight undocumented migrants crossing the border, prosecutors say. One of the men pointed a rifle at Kelly and he responded by firing several warning shots over their heads, the motion says.
