Jurors will have to agree unanimously that he should be put to death or the 35-year-old former Paterson, New Jersey, resident will spend the rest of his life in a high-security prison.

The judge appeared to be of the view that he would get to decide the method of execution for Saipov because New York State does not have the death penalty. It appeared the attorneys gently corrected him but what they said was not audible and the judge did not bring it up in front of the jury.
Lawyers for Saipov, a Uzbekistan citizen, never contested that he killed eight people by speeding a rented truck across a bike path in lower Manhattan that is popular with tourists. Killed were a woman visiting from Belgium with her family, five friends from Argentina and two Americans. Eighteen others were seriously injured.
