Texas Attorney General Ken Paxton and Comptroller Glenn Hegar continue to dispute whether Paxton should have been paid while his impeachment was unresolved....

“Because we disagree with your interpretation on this very important issue, we encourage you to file a writ of mandamus with the Texas Supreme Court for a definitive ruling,” states a letter from Victoria North, general counsel for the comptroller.Advertisement

In Webster’s letter, the first assistant attorney general noted that the Texas Constitution guarantees Paxton a salary as long as he remains the duly elected attorney general. And that while the Constitution states any impeached elected official must be suspended from duty, it makes no determination about the official’s salary.

North conceded that the situation is “unprecedented” but reiterated that the state budget provided funding for only one attorney general. Paying Paxton for the time he was suspended put taxpayers on the hook for his salary and the salaries of interim attorneys general appointed to head the office while the articles of impeachment were pending.

He was acquitted on the charges that included allegations of bribery, corruption and other wrongdoings.. Philip Jankowski has covered government, politics and criminal justice in Texas for 13 years.
