It was largely based on statements made by some members of the Colorado Civil Rights Commission" — which threw its support behind Craig and Mullins in 2014 —"and not on any inappropriate conduct by Charlie and David.
That's not the way the U.S. District Court saw it, however. The defendants in the case, including Colorado Civil Rights Commission head Aubrey Elenis and its other members, as well as Colorado Attorney General Phil Weiser, were granted summary judgment in September 2019, largely because the case was hypothetical: Smith filed suit before posting any statement, and no state body had punished her.
