Martin Tobin, a renowned pulmonologist, showed a federal civil jury in Dallas on Wednesday police body-camera footage that showed Timpa’s head slightly roll...
Timpa died after he called 911 from the parking lot of a porn store on Mockingbird Lane and reported he was afraid and unarmed, adding he was off his prescription medication for anxiety and schizophrenia. Body-camera footage shows he was handcuffed behind his back and pinned face down by officers as he yelled for help. He died within the hour.
The trial, which started Monday, has centered on medical science as both sides dispute whether the officers’ actions led to Timpa’s death, police training on how to handle mental-health calls and Timpa’s level of resistance and medical history. Several jurors hurriedly scribbled notes as Tobin voiced the cause of death he determined for Timpa: a low level of oxygen, which caused damage to his brain and heart.“We see the compressive asphyxia right in front of our eyes,” Tobin said. Timpa was pressed against the ground, he added, and in Texas in August, the ground is “extremely hard.”
Henley showed the jury screengrab of Dillard’s knee on Timpa’s back. Tobin called attention not to Dillard’s knee, but to his toe, which appeared to be moving in the air. That’s a sign all of Dillard’s weight, Tobin testified, was pressed into Timpa, not the ground.
