Among the deficiencies cited: allowing a lieutenant who assisted a supervisor during the chase to conduct the follow-up probe into the pursuit that killed the 13-year-old in 2019.
The report, filed Monday in U.S. District Court, called the department’s examination a “limited and incomplete review of the incident.”
Monday’s report comes at a critical time in Cleveland. Last month, Issue 24 passed with nearly 60% of the city’s vote. The charter amendment expands civilian oversight of the department and the system that determines the discipline of officers. The push stems from frustration over a system that some residents said failed to address officer misconduct.
Gregory White, the city’s former leader in the reform process, said he had not seen the final copy of the monitor’s report. The office, a non-police agency that investigates complaints against officers, presents its cases to the review board, which then determines whether there was wrongdoing. If it finds misconduct, it recommends discipline to the chief and safety director. Aden’s team also studied hearings before Karrie Howard, the city’s director of public safety.
“It is apparent that the city was looking to absolve the officers because it knew the officers had made a series of serious mistakes during the chase,” said Stanley Jackson, an attorney with the Cochran Firm in Cleveland who represents the Chappman family. “They looked to find a way to cover it up.”
