With no criminal charges filed nearly two years after her son was killed in Harris County Jail, LaRhonda Biggles has filed a wrongful death lawsuit against the sheriff's office and 11 former employees in federal court.

“It just gets worse and worse as it gets closer to the two years because I’m like, what, we are going to go two years and not know nothing?” Biggles told the Chronicle earlier this month. “We want to know. That’s all I’m asking – I want to know and I want somebody to be held accountable for what they did to my child.”

Simmons was booked in Harris County Jail on Feb. 10, 2021, after being arrested on suspicion of being a felon in possession of a weapon. The first alleged beating at the facility transpired on Feb. 16, when Simmons clogged the toilet with his clothing causing water to overflow into the cell. The 11 now terminated employees attacked, beat, kicked, punched and struck Simmons in the head multiple times, the suit states.

The employees involved in the attack did not document the use of force, which was a violation of the policies and procedures of the Harris County Sheriff’s Office, according to the suit. Simmons' clothing, bedding and belongings were removed from his cell after the altercation, the suit alleges.Later that night, Simmons threw a meal tray back toward Officer Dixon who was distributing lunch. In response, Dixon punched Simmons in the head, according to the suit.

None of the incidents were caught on camera, and there is no footage of the altercations, the sheriff's office said. It is the belief that incidents were not intentionally out of the line of sight of the cameras in the area, Gonzalez said in May 2021.Biggles is demanding in excess of $1 million, including interest, delay damages, costs of suit and survival and wrongful death damages.
