A Merrillville teen’s murder case was dropped after prosecutors wrote they couldn’t prove it wasn’t self-defense after his bail hearing, according to court filings on Oct. 19.
Ryan J. Rose, then 17, was charged murder in July 2022 in the Jan. 19, 2022 shooting death of Jarcques Gaston, 23. Police arrived and found Gaston shot lying face down on the inside steps inside a bi-level home on the 7800 block of Hendricks Street. They found shell casings on the landing and at the top of the steps. A witness said they heard several loud “booms,” at least 5-6 shots.
“He was freaking out,” the witness said of Rose. “I don’t know what to do, should I call the cops,” Rose said, according to the affidavit. Police learned Gaston and Rose were friends a few years back, but it had tapered off. In the affidavit, investigators said Rose believed Gaston was armed and was going to pull “something” out of his pocket. Rose reportedly said Gaston sent threatening texts about a week earlier, according to the affidavit.
