Planned Parenthood Association of Utah is asking a judge to consider a preliminary injunction against the new law as part of its case challenging the state’s abortion trigger ban.
“Meanwhile, however, the Utah Legislature has attempted to accomplish by other means what the Utah courts have prevented it from doing directly — ban abortion in Utah,” the filing reads.signed into law by Gov. Spencer CoxAlthough abortion is currently legal in Utah up to 18 weeks, under the new law the state will stop renewing and issuing licenses for abortion clinics starting May 2, and will completely outlaw them in January 2024.
The bill will move all abortions to facilities that meet the state’s definition of a “hospital” under its abortion laws. While that definition includes general hospitals, it also includes clinics “certified by the department as providing equipment and personnel sufficient in quantity and quality to provide the same degree of safety as ... a general hospital licensed by the department.”
The public policy director for Planned Parenthood, Jason Stevenson, said in a news conference held prior to the bill’s passage that the “hospital-only restriction of this bill would stop these clinics from providing abortions anyway on May 3.” Its attorneys are asking for expedited consideration of a potential preliminary injunction, with hopes a decision will come down before next month.
