Prosecutors asked why Trump wasn’t indicted for campaign-finance violations

By Rebecca Ballhaus Updated July 19, 2019 4:18 pm ET WASHINGTON—The House Oversight Committee chairman asked Manhattan federal prosecutors whether a Justice Department policy barring charges against a sitting president played any role in their decision not to indict President Trump for campaign-finance violations in which he was implicated.

Former special counsel Robert Mueller earlier this year said upon the conclusion of his investigation he opted not to make a decision on whether the president had obstructed justice, in part because of the Justice Department policy that bars charging sitting presidents. But, he said in May, “If we had had confidence that the president clearly did not commit a crime, we would have said so.”

Michael Cohen, Mr. Trump’s longtime lawyer, pleaded guilty in August 2018 to two campaign-finance violations connected to hush-money payments he arranged during the 2016 campaign to two women who alleged affairs with Mr. Trump. Prosecutors said in a December court filing that Mr. Cohen had done so at Mr. Trump’s direction. Mr. Cohen also pleaded guilty to tax evasion as well as making false statements to banks and to Congress, and he began a three-year prison sentence in May.

Asked at a news conference Friday whether Justice Department officials were involved in Manhattan prosecutors’ decision not to charge the president, Deputy Attorney General Jeffrey Rosen said only that “experienced prosecutors” had handled the campaign-finance investigation and that they had made their decisions “on the merits.”

Mr. Trump, asked Friday why he was on the calls with Mr. Cohen, told reporters: “I don’t really know. I’d have to look into it. That’s a long time ago.”
