A 51-year-old man is scheduled for arraignment Wednesday in the Sunday homicide, the city’s 25th of the year.
SAN JOSE — A man has been charged with settingof another man sleeping inside, according to authorities.
Martin Gustavo Cabrera, 51, was charged with murder Wednesday in the Sunday death at Barnard and Pomona avenues, in an industrial zone off Monterey Road. The San Jose Fire Department was called at 5:47 a.m. Sunday for a report of a vehicle fire. Responding firefighters found a small SUV “engulfed in flames,” fire spokeswoman Erica Ray said. After they put out the fire, firefighters found a person dead inside the vehicle.
The victim has not been publicly identified pending his formal identification and notification of his next of kin by the Santa Clara County Medical Examiner-Coroner’s Office. An ensuing investigation conducted by San Jose police and an SJFD arson investigator identified Cabrera as the primary suspect behind the fire. Cabrera was located at a nearby encampment; one day after the fire, he was booked into the Santa Clara County Main Jail and was being held without bail.
