Abortion pill restrictions are being implemented at a state level, creating new battlegrounds for rights advocates

FDA moves make medication abortion more accessible but a patchwork of state laws and pending legislation are seeking to restrict it.In the aftermath of the Supreme Court’s overturn of Roe v. Wade, abortion pills—used in more than half of recent pregnancy terminations in the U.S.—are likely to be at the forefront of legal battles on the state level this year.

With a divided Congress, state legislatures are a likely source of new abortion policies. All but two states with near-total bans have Republican trifectas, meaning they hold the governorship and a majority in both chambers. Eight states have had Republican trifectas for five continuous cycles. Many states with Republican trifectas have restrictions that target abortion pills. Two states have partial bans on medication abortion, with the ban starting at 10 weeks in Indiana and seven in Texas, which already has a near-total abortion ban. Three states have medication-abortion bans pending.
