Warning: contains spoilers for Uncanny Avengers #1!Captain America's big philosophical difference to Superman shows that while Marvel and DC may each have a 'boy scout' superhero, only one of them truly lives up to that label. The Fall of X era has seen mutantkind framed for attacks on humanity and subjected to an ongoing genocide by the human-supremacist group Orchis.
Steve cites the Geneva Conventions in relation to Captain Krakoa pretending to be a mutant, making it clear that he considers mutants to be in a state of literal war. Interestingly, that also appears to be Marvel's attitude - Duggan also cited the Geneva Conventions in a recent interview with CBR, referring to Kate Pryde brutally killing their agents in X-Men #25, and saying:
Superman's No Kill Rule Is Absolute In modern comics, Superman is one of the most committed 'no kill' heroes written today, risking his life and wellbeing to spare anyone and everyone he can. This was emphasized in the recent Action Comics #1053 story 'Unmade' , in which Superman lays out his expectations: he expects his entire family to avoid killing, even when it risks their lives, because their enemies must be given the opportunity to change.
