Nineteen states requested the Supreme Court of the United States put Title 42 on hold for a review of the U.S. District Court's decision to allow the measure to expire on Dec. 21.
The panel discussed the latest on the border crisis and how the ending of the policy will impact the ongoing crisis., requesting the expiration of Title 42 be put on hold until a higher court can review the decision made by the U.S. District Court of the District of Columbia to allow its sunsetting.
The applicants suggest, in the legal document, that the federal government picks and chooses when to use certiorari, or a higher court review. In this case, the applicants said the Federal Government sought to leverage a litigation loss as a basis to immediately repeal an unwanted rule without using notice-and-comment procedures, circumventing the Administrative Procedure Act, or APA.
