OpEd: 'The right for students to present themselves how they choose is one worth fighting for and defending. The right to get others sick is not.'

Regardless of the policy’s intent, students felt “uncomfortable, distracted for fear of being teased by their peers if their underwear showed, or corrected by teachers for not sitting in a ‘ladylike’ position in class,” Galen Sherwin, senior staff attorney with the ACLU Women’s Rights Project, about the case earlier this year.

on another part of the ruling, which decided that North Carolina public charter schools don’t have to comply with constitutional provisions. “Yet girls in certain public schools in North Carolina are required to wear skirts to comply with the outmoded and illogical viewpoint that courteous behavior on the part of both sexes cannot be achieved unless girls wear clothing that reinforces sex stereotypes and signals that girls are not as capable and resilient as boys.

Countless girls — especially, as Sherwin explained, those who are otherwise marginalized — and women can list off examples where dress codes actually infringed on their right to access their education. I personally received at least one detention each year of high school for clothes that were arbitrarily deemed “too distracting” by teachers.

As we hear claims of “personal freedom” used to justify defiance of public health practices — essentially arguing for the individual right to potentially infect others, despite the needs of students who, for any variety of reasons, might not be able to get vaccinated — why can’t we focus on the freedom to exist in our body free from scrutiny? Free from others’ assumptions about gender? The right for students to present themselves how they choose is one worth fighting for and defending.
