'This case should have been dismissed,' Justice Department spokesperson Kelly Laco told Newsweek in a written statement.

Deepak Gupta, who is representing plaintiffs in two other emoluments lawsuits again the president, toldhe was"not surprised to hear" this announcement from the Justice Department on Tuesday following Sullivan's ruling, especially because the Fourth Circuit agreed to hear Trump's petition for a writ of mandamus in a separate case out of Maryland, where Gupta is representing the District of Columbia and the state of Maryland in their emoluments lawsuit against the president.

Gupta called the department's gambit an"extraordinary request," saying that the standards for obtaining a writ of mandamus"are very high." The case overseen by Sullivan involves more than 200 Democratic members of Congress, who have put their names to a suit alleging the president is in violation of the Foreign Emoluments Clause of the Constitution, which is generally understood to prohibit transactions between government employees and foreign officials.
