Twitter took action against President Donald Trump’s tweet of a meme video for copyright infringement, which featured a clip from the music video of Nickelback’s 2006 hit “Photograph.”:

A Twitter spokesperson said the company responded to a valid copyright claim.: Twitter’s policy has been to leave up tweets from world leaders that may break the site’s rules because they are newsworthy. Trump in particular has drawn complaints from some that his tweets are allowed to remain online even as he skirts rules against harassment and threats.
Twitter has taken down only one of Trump’s tweets this year. The tweet, which also may have violated copyright law, included music from the Batman movie: In the realm of copyright law, there is a growing consensus than memes constitute “fair use,” which allows for the use of copyrighted material without permission as long as it “transforms” the original work in some way, such as to comment upon, criticize or parody it.
Trump’s Nickelback video could be considered fair use, Cornell University legal scholar James Grimmelmann told: Trump’s tweet comes less than a week after House Democrats launched an impeachment inquiry in response to a phone call between Trump and Ukraine’s president Volodymyr Zelensky. On the July call, Trump directed Zelensky to investigate Joe Biden and his son Hunter for corruption.
