President Biden is expected to announce a new, targeted federal eviction ban today, according to four sources with knowledge of the decision. This would replace the ban that expired over the weekend and set up a potential clash with the Supreme Court.

President Joe Biden is expected to announce a new, targeted federal eviction ban on Tuesday to replace the one that expired over the weekend, according to four sources with knowledge of the decision, setting up a potential clash with the Supreme Court.

Biden called House Speaker Nancy Pelosi to inform her of the decision. The White House also gave progressive lawmakers a heads up. The move by Biden came as Democratic lawmakers stepped up pressure on the White House to act, after House Democrats failed to marshal the votes to extend the ban on their own last week. The White House announcement last Thursday to let the ban expire put millions of Americans at risk of losing their homes during the pandemic.

The White House last week said it would not renew the moratorium imposed by the Centers for Disease Control and Prevention because of a June Supreme court decision that indicated a majority of justices believed the CDC overstepped its authority. Landlords challenged the moratorium in the courts, arguing it cost them billions of dollars per month.

Prior to Tuesday's announcement, Congressional Progressive Caucus Chairwoman Pramila Jayapal said any CDC ban would need to be bolstered by congressional action.Filed Under:
