OAKLAND — Two men charged with murder in a 2017 shooting death in Newark were both sentenced to six years after accepting robbery convictions in deals with prosecutors, court records show.
Robert Moreno, 48, and Josue Perez, 30, were charged with murdering 29-year-old Roque Leonel Valencia in a shooting prosecutors alleged was motivated by a four-ounce methamphetamine deal that turned into a robbery.told police after his arrest that Moreno was holding the gun and shot Valencia during a struggle, while Moreno claimed to be asleep for the whole incident, court records show.
The sentences for both men were handed down Tuesday. Moreno’s attorney, Ernie Castillo, said he expects his client will be released within a year. Perez’s attorney, a deputy public defender, declined to comment through an office spokesman. At the Tuesday sentencing hearing, members of Valenica’s family spoke out against the deal, calling it too lenient for what they called the clear-cut murder of their loved one.
The equal sentences come with a bitter irony for Perez: He agreed to testify against his co-defendant as part of the deal, and in the end got no more leniency for his cooperation with authorities. Had Moreno’s case gone to trial, Castillo said he would have attacked Perez’s credibility by calling him a known Oakland gang member with a motive to make Moreno look guilty.“Mr.
