U of S loses court case over worker fired for taking rags

The university was ordered to pay court costs in a case stemming from the theft of about $5 worth of supplies.

A U of S spokeswoman said the university would not comment on matters related to personnel.

Court documents reveal the tale began in 2019 when someone called a university hotline to report that a member of the caretaking staff was stealing supplies. This led managers to set up a motion-activated camera in a supply closet that reportedly captured footage of the employee coming in and putting cleaning rags into his lunch bag.Managers confronted the worker at a February 2019 meeting held alongside representatives from his union, CUPE Local 1975.

In a written decision issued in December 2020, arbitrator Daniel Ish sided with the union, finding problems with how management handled the matter. Ish noted that the February 2019 meeting was “frightening and intimidating” for the worker, which contributed to his manager’s conclusions that he wasn’t being truthful.

Ish also criticized the decision not to have an interpreter available, as the worker was not a native English speaker. While he wrote that the worker’s actions warranted discipline, Ish decided a six-month suspension coupled with an entry into the man’s employment record was sufficient punishment. The university appealed that decision, arguing Ish made errors in interpreting the law and that his decision was unreasonable. The appeal was dismissed in a written decision issued on Feb. 18 by Saskatoon Court of Queen’s Bench Justice Brian Scherman.
